Chapter 7
$1500 plus filing fees
Chapter 7 relief is the most commonly filed form of bankruptcy. If the debtor has insufficient funds after paying monthly necessity expenses (mortgage/rent, utilities, food, etc.) to pay any other claims, the debtor may obtain relief from most creditors under Chapter 7 of the Bankruptcy Code..
Chapter 13
Usually $3000 plus filing fees
(Variable depending upon complexity of case)
If the debtor has unpaid taxes (or what is otherwise considered priority or undischargeable debt) or makes sufficient income to partially repay outstanding claims after paying necessary expenses - the debtor must usually file under Chapter 13 of the Bankruptcy Code.
